Technically speaking I agree with you.
However doing these optimizations on a benchmark AND NOT DISCLOSING IT with your report about your hardware, not your software prowess, is fundamentally dishonest. Intel is very good at this, and has a long track record of doing just this kind of dishonest marketing.
