AArch64 is not a fully predicated instruction set, AArch32 is. Some predication is very useful to compilers however full predication is not often used and presents barriers to implementing high performance micro-architectures. Thus aarch64 retains useful predicated instructions and drops it everywhere else for performance reasons.

Compilers are perfectly willing to use them however the exact tradeoffs for this kind of thing are in the heads of various optimisation experts, one or two of which lurk or post on this forum.

At some point, since the ISA is open, someone is going to get bored put all the grotty things you need in an ISA to make it a good compiler target back and produce an incompatible but higher performance version. The resulting bun fight between whoever does this the RISC-V foundation is going to be interesting to watch.

Sadly no there are lots of different issues Spectre is just one of them. Some of them are intrinsic to architectural features like transactional memory and cannot be solved. An approach where what is enabled and what is done depends on the threat model has to be taken. For example you can have SMT and Transactional Memory on a 'trusted' machine running a database server which is only available to the outside world via an SQL interface. However as soon as you are sharing the machine between untrusted processes or untrusted VMs you can't.
